WBM attorneys have reached a $625,000 settlement in a case involving a Kentucky man killed in a mining accident.
James J. Falk was killed Oct. 27, 2010, after being struck by a shuttle car outside the entrance to the River View mine in Union, Ky. WBM filed suit on behalf of his estate against Auxier Welding Inc., which designed and manufactured the shuttle car.
The shuttle car was improperly designed leaving the operator of the car with an extremely restricted view ahead of Mr. Falk, said WBM partner John Whitfield. “Because of the restricted view, the driver of the shuttle car did not see Mr. Falk and ran over him, dragging him a significant amount of feet and ultimately killing him.”
To help illustrate design faults in the shuttle car, WBM used a DK Global-designed computer animation of the accident.
