FLSA Case Filed Against Five Guys Restaurants for Failure to Pay Overtime

On March 27, 2012, Plaintiff Valerie Turner filed an Amended Collective Action Complaint in the United States District Court for the District of Maryland against Five Guys Enterprises, LLC and related entities asserting  Fair Labor Standards Act claims.  Plaintiff alleges that she, and other assistant store managers-in-training who worked at Five Guys, were misclassified under the FLSA and were not paid overtime for all hours worked over 40 per week.  The lawsuit seeks to recover overtime pay on their behalf.  The Defendants have answered, and the case will proceed to discovery.  The lawsuit is entitled Turner et al. v. Five Guys Enterprises, LLC, et al.,  No. 1:11-cv-03718-RDB (D.
