Consumers who purchased prescription painkiller Vioxx before Oct. 1, 2004 are entitled to $50 or more — even if they don’t have a record of the purchase — under a class action settlement reached with the drug manufacturer Merck. The deadline for claim applications is May 6.
Individuals who have records of the purchase are entitled to full reimbursement of out-of-pocket expenses. Consumers also may be paid up to $75 additionally for visiting with a doctor to discuss alternatives to the drug.

The $23 million class settlement covers consumers who had purchased Vioxx for themselves or for a family member. The drug was recalled in September 2004 after a clinical trial showed a significantly higher risk of heart attack for long-term users.
“This settlement is an important win for consumers, and health safety. Anyone who purchased the drug should take immediate advantage of the claim,” said Gary E. Mason, a WBM partner who represented consumers in the complaint.
