Whitfield Bryson & Mason is investigating claims against Floor & Decor, a specialty retailer in the laminate flooring market, for allegedly falsely warranting, advertising and selling flooring that fails to comply with relevant and applicable formaldehyde standards.
Formaldehyde is a gas which is categorized as a known human carcinogen by the United States National Toxicology Program and the International Agency for Research on Cancer and can cause cancer, asthma, chronic respiratory irritation and other ailments. There are strict standards for the permissible level of formaldehyde emissions in household items, such as flooring.
Floor & Decor advertises on its product labels, website and elsewhere that its laminate flooring meets or exceeds strict formaldehyde emissions standards. However, contrary to Floor & Decor’s repeated, detailed representation regarding its compliance with the applicable standards, the formaldehyde emissions from the company’s flooring may be multiple times the maximum permissible limits set by those standards at the time of purchase. Further, it is unknown how long these allegedly high formaldehyde emissions continue after the time of purchase.
Floor & Decor has also reportedly failed to alert consumers about the alleged high levels of formaldehyde in its laminate wood flooring.
